Melanie is a senior associate at Russell Kennedy who specialises in health and aged care law. She is also a medical practitioner, currently on the COVID-19 sub-register, and was previously a medical negligence lawyer. Melanie supports aged care providers in complying with their responsibilities under the Aged Care Act 1997 and other relevant laws as well as advising providers, retirement villages and health services on their policies, procedures, guidelines – as well as other types of forms (such as advance care directives and consent forms). Melanie also advises health and aged care clients on issues such as privacy and duty of care, and assists them in supporting open disclosure and managing complaints.

  • Assisting aged care providers in responding to the Department of Health and Aged Care Quality and Safety Commission
  • Assisting aged care providers in relation to the Royal Commission into Aged Care Quality and Safety
  • Providing advice to aged care providers on the aged care quality standards including in relation to organisational and clinical governance (Standard 8)
  • Assisting providers in responding to resident/client complaints
  • Advising aged care providers and retirement village operators of their obligations under legislation
  • Advising aged care providers, retirement villages, DHHS and health services on policies around issues such as advance care directives, voluntary assisted dying, dignity of risk and CCTV
  • Acting for health providers in relation to complaints, claims and inquests
