Kelly is an experienced employment and industrial relations practitioner with a strong understanding of commercial business drivers and objectives having worked in corporate environments before she was a lawyer.

Kelly regularly presents on employment law topics for clients and at industry events. She was recognised by Doyle’s Guide in 2022 as a Rising Star in the area of Employment and WHS in Victoria.

Experience

  • Advises employers on the full range of employment law including preparing contracts of employment and workplace policies and advising in relation to employee flexibility arrangements, termination of employment, redundancies, restructures and transfer of business
  • Advises and supports employers through various claims relating to employment including unfair dismissals, general protections, underpayments, discrimination (at both the state and federal level) and bullying
  • Interpreting and advising in relation rights and obligations in enterprise agreements, modern awards and contracts of employment
  • Assist clients to manage long term ill and injured employees and return to work, underperformance, misconduct and disciplinary matters, including advising in relation to workplace investigations
  • Advising employers of the risks of industrial action
  • Advising employers regarding termination and variation of enterprise agreement, negotiating enterprise agreements and supporting employers through the Fair Work Commission approval process
  • Advocacy experience and has appeared in various jurisdictions including the Fair Work Commission, Australian Human Rights Commission and State Courts
  • Advising employers on restraints of trade and enforcement proceedings in the Courts
  • Advising employers on independent contractor arrangements and sham contracting
