Paul is a Principal and the Managing Director of Russell Kennedy. He also has extensive experience in commercial law, including contracts, mergers and acquisitions and the establishment of commercial enterprises through structures such as partnerships, joint ventures, discretionary trusts and unit trusts.

He has acted for a wide range of public and private sector clients in relation to commercial contracts, transactions, trade practices matters, privacy laws and in providing general commercial advice. He also has particular expertise in intellectual property matters, including the commercial exploitation of intellectual property and technology, trade marks and passing off disputes, and technology law.

Experience

  • Acting for buyers and sellers in mergers and acquisitions transactions in a range of industries, including professional services, retirement living and aged care, wholesale, retail and manufacturing
  • Negotiating the resolution of partnership and shareholder disputes
  • Negotiating of a wide range of commercial agreements including licensing agreements, supply agreements, services agreements, and standard form agreements of various types
  • Advising on business structures and restructures, including in relation to companies, trusts, partnerships, joint ventures and not-for-profit organisations
  • Advising public and private sector organisations on the identification, procurement, ownership, protection and licensing of intellectual property assets
  • Prosecuting registered trade mark and registered design applications and renewals
  • Acting for public and private sector clients on the procurement of information technology goods and services
  • Advising a diverse range of public and private sector clients on information privacy
  • Advising commercial organisations, municipal councils and statutory authorities on all aspects of competition law, including exclusionary and restrictive agreements and third line forcing
  • Obtaining informal clearances from the ACCC for mergers and acquisitions, notifications to ACCC and conducting compliance training
  • Advising on compliance with the Australian Consumer Law
