Suzanne is a general commercial litigator, focusing on the Property, Building and Construction, Retirement Living and Education industries. She has experience in a vast range of disputes relevant to these industries, including with respect to leasing, adverse possession, breach of contract, defective building work, expert determinations and retirement living resident complaints, fee disputes, Australian Consumer Law matters and some defamation. Suzanne also has experience in Corporations Act matters involving Oppression, breach of director’s duties and insolvency. Suzanne provides strategic advice with a focus on practical outcomes.

Experience

  • Acting for clients in a range of Property disputes including those related to ownership rights, easements, covenants, leases and adverse possession
  • Acting for Retirement Village and Residential Tenancy Part IVA Park operators regarding resident complaints, disputes and VCAT proceedings relating to breach of contract claims and consumer claims
  • Assisting clients to navigate retail and commercial lease disputes
  • Acting for shareholders and directors in Corporations Act based disputes regarding minority shareholder oppression, breach of director’s duties and derivative actions
  • Acting for creditors and liquidators in insolvency related proceedings
  • Acting for builders, developers and owners in building and construction disputes both domestic and commercial regarding defect claims, breach of warranty claims, contribution claims and challenges to expert assessments
  • Providing advice on contract disputes including breach of contract and assessment of damages, and the impact of the Australian Consumer Law in contract disputes
  • Representing clients in all Victorian Courts, VCAT and the Civil Federal Court system
  • Defamation claims by individuals and Not-For-Profit Organisations
