Emma has 20 years of experience in all aspects of leasing and licensing transactions, advice and disputes. She acts for tenants, landlords, government authorities, as well as the not-for-profit sector.

Emma has specialised experience in drafting and negotiating licences and leases for landlord and tenant clients and for metropolitan and regional councils and community organisations. She provides advice on all aspects of commercial leasing including crown leasing, retail leasing and related legislation and represents clients at mediations facilitated by the Victorian Small Business Commission. Emma has advised government on the national harmonisation of leasing disclosure statements.

Emma is also Russell Kennedy’s Pro Bono Practice Group Leader and leads our refugee law practice.

Experience

  • Acting on behalf of tenants, landlords, councils and state government authorities on all aspects of leasing transactions, including those relating to office, retail, development and Crown land premises, telecommunication and railway leases and licences, education facilities, community and social housing initiatives and markets.

  • Providing technical advice and preparing tailored suites of leasing documents for local councils and state government departments.

  • Advising on retail leasing legislation in all Australian jurisdictions and acting in tenancy disputes at mediations facilitated by the Victorian Small Business Commission and VCAT.

  • Providing Pro Bono assistance for refugee and humanitarian visa applicants.

  • Acting in Federal Court, Federal Circuit Court and High Court proceedings relating to refugee matters.
