Suzanne is a general commercial litigator, focusing on the Property, Retirement Living, Construction and Education industries. She has over 15 years of experience in a vast range of disputes relevant to these industries, including with respect to retail and commercial leasing, property status and ownership disputes, road disputes, judicial review, easement disputes, breach of contract, Australian Consumer Law matters, defective building work, novation and assignment of contracts, expert determinations, retirement living resident complaints, fee disputes and defamation. Suzanne also has experience in Corporations Act related matters including oppression, breach of director’s duties and insolvency. She has significant experience in alternative dispute resolution, providing strategic advice with a focus on practical outcomes. Suzanne will be the facilitator for this webinar.

Walter MacCallum

Principal

Walter has 21 years of extensive experience in commercial litigation in all court jurisdictions, acting for, and advising, individual clients, family enterprises, start-ups and commercial operations that range from small-to-medium enterprises to large corporations, including not-for-profits. Walter’s work is principally based on the understanding that there are often no winners in lengthy contested litigation and early resolutions are often preferable. Nahum Ayliffe

Nahum Ayliffe

Special Counsel

Nahum is an experienced commercial litigator and leading insolvency lawyer within Russell Kennedy’s insolvency team in Melbourne. He regularly acts for external administrators and bankruptcy trustees, creditors, company directors and shareholders in insolvency and restructuring matters. Nahum has assisted clients in a range of commercial disputes, including breaches of director’s duties claims, contractual and shareholder disputes, property and equitable claims, and misleading and deceptive conduct claims. Nahum’s experience in business is evident in his commercial approach to litigation, whether exploring alternative dispute resolution options, or prosecuting the client’s case through the relevant court or tribunal.

Joe Denina

Associate

Joe has experience in commercial litigation in all court jurisdictions, having appeared in the High Court of Australia, Federal and Federal Circuit Courts of Australia, New South Wales Supreme Court and Court of Appeal and New South Wales Land and Environment Court. He has also acted in the District Court and Local Court of New South Wales, Supreme, Magistrates and County Courts in Queensland, Victoria and Tasmania and the New South Wales Civil and Administrative Tribunal.
Joe has advised and acted for corporate clients ranging from small-to-medium enterprises to large multi-national corporations as well as directors, trustees and private clients. He assists his clients across a broad scope of complex disputes including contractual and financial disputes, insolvency and bankruptcy proceedings, trusts disputes, shareholder and franchise disputes in addition to recovering debts to preserve the financial status of a corporation or private client.

Joe has a particular focus on developing a thorough understanding of all the issues his clients are facing either in business or privately and aims to achieve the most efficient and realistic outcome, acknowledging that early resolutions can be preferable to contested litigation. Accordingly, Joe’s background and extensive legal, financial and business experience provide him with strong negotiation skills that have achieved positive outcomes for his clients outside of the court process.
