This webinar will discuss the debt collection process (including from estates) and provide debt prevention strategies that aged care providers and retirement living operators can implement to minimise risk of debt and ensure best practice moving forward.

The session will also cover the matters of probate, how to pursue a deceased estate in complex circumstances and how you can improve your practices to ensure fees are paid appropriately. 

Our presenters will outline what you can do to avoid reaching the debt recovery stage, and how providers and operators can better protect themselves when first admitting residents into facilities.

Joining us will be Ilana Kacev, Senior Associate from Russell Kennedy’s Wills & Estates team and Gareth Kerr, Associate in our Public Law and Litigation and Aged Care team. Victor Harcourt will facilitate the session and we will also have Russell Kennedy principals Anita Courtney and Suzanne Rieschieck answering your live questions during the webinar.

Victor has a Masters in Health and Medical Law and was named Best Lawyers' 2014 Melbourne Health and Aged Care Law "Lawyer of the Year" and was recognised in 2012 - 2020 for his expertise in Health and Aged Care Law.

He was also recognised in 2014 - 2020 for his expertise in Government Practice and in Retirement Villages and Senior Living Law in 2017 - 2020.

Anita is a principal in Russell Kennedy’s Aged Care team. She specialises in helping providers respond to, and challenge decisions of the aged care regulators including the Department of Health and Aged Care Quality and Safety Commission. Anita’s experience includes assisting providers in understanding their legislative and compliance responsibilities under the Aged Care Act and its principles, privacy legislation, sanctions and other laws.

Suzanne is a general commercial litigator, focusing on the Retirement Living, Education, Property and Building and Construction industries. She has experience in a vast range of disputes relevant to these industries, including with respect to leasing, adverse possession, breach of contract, defective building work, expert determinations and retirement living resident complaints, fee disputes, Australian Consumer Law matters and some defamation. Suzanne also has experience in insolvency matters and alternative dispute resolution, providing strategic advice with a focus on practical outcomes.
