Personal Injury & Compensation

Russell Kennedy draws on first-class experience to provide personal injury and compensation advice to clients including the Victorian WorkCover Authority (WorkSafe Victoria) and the Victorian State Government.

Our team’s vast technical expertise and disciplined case management approach allow us to deliver effective advice and achieve high recovery rates.

Recoveries

We’ve worked with the Victorian WorkCover Authority as part of their recoveries panel since 2005. We support them to recover compensation payments made to injured workers due to negligent third parties in matters relating to occupiers’ liability, labour hire, medical negligence and building incidents.

Common Law and Statutory Benefits

Our team has extensive experience acting for employers, insurers and WorkCover to defend common law damages claims and statutory benefit disputes. A member of the WorkSafe Victoria legal panel, we’re experts at identifying the primary issues in a dispute quickly and resolving them efficiently. Robust negotiators, we work hard to deliver the best outcome for you.

Victorian Government

We represent Victorian government departments and agencies in personal injury matters through contingent liability and risk assessment, document and evidence collection, development of case strategy, alternative dispute resolution, preparation for trial and the management of litigation through hearing. We’ve acted for government in common law negligence claims, breach of statutory duty, assault, battery, false imprisonment and wrongful death claims resulting in personal injury. We have substantial experience in actions pertaining to injuries arising out of the exercise of the various powers of the state, and injuries where the duties of the State are modified by statute.
