Environment Protection Regulations 2021, Environment Protection Transitional Regulations 2021 and Environment Reference Standard now made

On 25 May 2021 the Environment Protection Regulations 2021 and the Environment Protection Transitional Regulations 2021 were made with amendments from the second exposure drafts as set out in the Notice of Decision published in the Victorian Government Gazette.

Important changes are made to the ‘declaration of use’ and ‘determination’ provisions regulating industrial waste reuse, recycling and receipt. Prescribed industrial waste classifications in force prior to 30 June 2021 will now be extended by two years rather than a year.

Other important changes address ‘project site’ for the management and containment of lower end contaminated soils within public works increasing options.

On 26 May 2021 by publication in the Victorian Government Gazette the Environment Reference Standard was made by order of the Governor in Council, including amendments from the second exposure draft as set out in the Notice of Decision.

Amendments clarify that environmental indicators for groundwater do not apply to waters within constructed landfill cells and other matters relating to music noise.

Importantly the Environment Reference Standard now specifically recognises that all places in Victoria exist on the traditional country of Aboriginal Victorians.

The Environment Protection Regulations 2021, Environment Protection Transitional Regulations 2021 and Environment Reference Standard will come into operation on 1 July 2021.
