Poor performance creates a significant burden for organisations, and should not be ignored. However, employers face a number of risks when managing employee performance issues.  

An employee may dispute that they have performance issues, allege workplace bullying by the supervisors responsible for reviewing their performance, or otherwise absent themselves from work during the performance management process. 

Monitoring and identifying issues with performance is also more difficult in an era where employees are more frequently working from home.  In these situations, determining the appropriate course of action can be challenging for employers.

In this webinar, Ben Tallboys, Principal, and Natasha Sim, Associate, will provide an overview of key legal issues that arise when monitoring and managing staff performance, and how to practically address these issues. 

This discussion will specifically cover:

  • Monitoring employee performance, including dealing with issues that arise when employees work from home;
  • Identifying performance issues, including the distinction between underperformance and misconduct; and
  • Managing issues that arise during the performance management process.
