Hadi Mazloum is a special counsel in the Dispute Resolution team at Russell Kennedy, Hadi has extensive experience in tax and commercial disputes, with particular emphasis in respect of the latter on insolvency, corporations, contract, trusts and equity and property law.

Hadi has represented taxpayers and the Commissioner of Taxation for over 12 years in debt recovery, Part IVC and family law proceedings where the Commissioner has intervened.

Hadi’s taxation expertise spans State and Federal taxes including Duties, Land Tax, Division 7A, CGT, GST, capital/revenue, trusts and Part IVA. Hadi has also represented tax agents in proceedings against the Tax Practitioners’ Board.

Hadi also specialises in charities law and has advised and appeared in matters regarding the registration of charities and has particular expertise in respect of the classification of ‘public benevolent institutions’.

Prior to RK, Hadi practised as a barrister for 9 years.

Experience

  • Acting for the Commissioner of Taxation on a range of matters including:
    • Audits and objections including matters involving complex questions of valuation, transfer pricing and legal professional privilege issues;
    • Numerous debt-recovery proceedings, seeking summary judgment in respect of unpaid tax assessments;
    • Proceedings whereby the taxpayer is seeking to review an objection decision in relation to a tax; and
    • Family Law proceedings where the Commissioner has intervened to seek payment of a debt owed by one or both of the parties to the marriage.
  • Appearing for and against liquidators in examinations pursuant to sections 596A and 596B of the Corporations Act 2001 (Cth); providing advice as to voidable transactions including unfair preferences; advice and appearance work in relation to winding-up matters and personal bankruptcy.
  • Acting for and against the Commissioner for the AFP in relation to restraining orders and exclusion applications pursuant to the Proceeds of Crime Act 2002.
  • Acting for the applicant to challenge constitutional validity of the Assisted Reproductive Treatment Act 2008 (Vic) pertaining to the access of IVF – this case resulted in the relevant statutory provision being deemed constitutionally invalid which in turn led to parliament amending the Act.
  • Acting for and advising taxpayers in all taxation proceedings including prelitigation – for example acting for a taxpayer and appearing at the General Anti Avoidance Rule (GAAR) Panel in respect of a Part IVA dispute; advising taxpayers on all aspects of State and Federal taxation laws.
  • Acting for individuals, companies and trustees in matters spanning contract law, consumer law, trusts and equity and corporations law.
  • Advising a superannuation trustee and fund in relation to all litigious matters including numerous breach of contract claims and appearing at a dispute in relation to a share sale deed.
  • Representing company directors at director banning hearings at the Australian Securities and Investments Commission.
