Employers commonly structure their remuneration arrangements so that an employee's annual salary satisfies any minimum entitlements arising under an applicable Modern Award or Enterprise Agreement. However, a landmark Federal Court decision has fundamentally clarified — and in important respects narrowed — the circumstances in which employers can lawfully rely on annualised salary arrangements and contractual set-off clauses.

The decision carries wide-ranging implications for businesses across all industries. In addition to contractual offsetting, it sheds light on employers' record-keeping obligations and the steps required to validly reach agreement with employees to vary their hours of work and shift arrangements.

The decision exposes the practical challenges and legal risks associated with annualised salary arrangements, and the very real consequences of getting it wrong. In this webinar, we will explain how businesses need to respond to ensure that they are not underpaying staff.
