Who is likely to be affected
The Code binds APP entities that are providers of a social media service, relevant electronic service or designated internet service (as defined in the Online Safety Act 2021) where that service is likely to be accessed by children or is primarily concerned with children’s activities, for example:
- educational technology providers offering learning platforms, student portals or learning management systems with messaging, chat or content-sharing functionality, and school-run apps;
- gaming, streaming and content platforms;
- general-audience apps and websites that children may access even if not the intended audience;
- wellbeing apps and connected-device providers; and
- retailers and other digital service providers operating platforms with interactive features, such as reviews, forums or content feeds, that children may use.
Private schools, clubs and youth programs that build and operate their own such app or platform may fall within this same category and be directly bound by the Code. By contrast, organisations that only use or subscribe to a third-party provider's platform or tools, rather than being the provider themselves, may not be directly bound by the Code, but will still need to consider its implications when selecting and engaging third-party technology providers.
Who should attend
Privacy, risk, compliance, product and digital platform teams at technology providers directly bound by the Code, together with private school and club administrators and other organisations responsible for procuring, building or operating apps and online platforms, whether you provide the technology, build your own, or engage a third party's technology.
The Children’s Online Privacy Code marks a significant shift in how organisations will need to design, explain and manage children’s privacy online. Tabled to be in place by 10 December 2026, the Code will apply well beyond social media, affecting any Privacy Act-regulated organisation offering an online service likely to be accessed by children, or primarily concerned with children’s activities, regardless of the organisation’s size, sector or commercial purpose.
