It has recently been reported that up to two in five applicants are now using artificial intelligence to assist with unfair dismissal and general protections claims (and the real figure is likely higher), alongside a surge in claim volumes before the Fair Work Commission.
This signals more than just a shift in behaviour. It points to a fundamental change in how workplace issues and disputes are initiated and managed.
We are likely to see:
- Transformation in FWC processes to manage AI assisted claims
- Broader procedural and legislative reform, including the recent introduction of the Workplace Relations Legislation Amendment (Building Cooperative Workplaces No. 1) Bill 2026
- Flow on impacts for courts, workplace investigations and HR processes
In many ways, this could represent the most significant transformation in workplace relations since the introduction of the Fair Work Act 2009 (Cth).
